Can a passenger claim compensation if the driver of the vehicle was drunk ?
Yes, you can still receive compensation if the driver was drunk, however, the amount may be reduced if you were aware that the driver was drunk when you got into the vehicle.
This is called contributory negligence and the compensation that you could receive will be reduced by a certain percentage, usually around 25%. So for example, if you would have received £10,000, if you knew the driver was drunk you might only get £7500. The percentage amount is not set in stone and will vary according to the accident.
