Can I make a claim for an accident if I was at fault?
If you were partly at fault for causing the accident, then you may be eligible to make a claim. This is very common, for example, there are many car accidents where each person is partly to blame. It is also common in work accidents where the employee is partly responsible.
What has split liability?
If both parties involved in an accident are partly at fault for causing the accident, the case may settle on a "split liability basis".
Liability is split according to the blame of each party. If liability is split 50/50, each party is found to be equally to blame for their actions in causing the accident. If the case was worth £30,000, then each party would receive £15,000 compensation.
Who decides the proportion of split liability?
Usually, the solicitor representing you will come to an agreement with the third-party insurer to split the liability on a 50/50 basis. Or another split liability example might be 75/25 in your favour. Each case will depend on its own facts.
