Some people are put off from making a claim for an accident at work out of the fear that they will lose their job. It is however illegal for your employer to dismiss you on the basis of you making a claim for an accident at work.
All companies have employer’s liability insurance, which is there to pay for worker injury claims. Your claim will be against your employer’s insurance company, not your employer.
Can my employer treat me differently?
Your employer cannot treat you differently in the workplace if you’re making a claim against them. If they dismiss you it could be possible to make an unfair dismissal claim.
What are my employer’s legal responsibilities?
Your employer is legally required to implement the appropriate measures to keep you safe from injury at work. This means they must :
- Provide a safe workplace and competent colleagues
- Give health and safety training
- Provide proper protective clothing
- Keep machinery and equipment properly maintained.
If an employee is injured they should report the incident in the company accident book, and receive sick pay if applicable. They also have the right to seek to make a compensation claim.
Who pays my compensation?
It is important to remember that all employers, regardless of the size of the company, are legally obliged to have insurance in place to cover any potential compensation payment. Compensation for an accident at work is therefore paid for by the insurance company and not directly from the employer.
If the company that you worked for has ceased trading, and is in administration or liquidation, it is still possible to make a claim against them, this will be dealt with by the insurers at the time of the accident.
