How do I make a claim?

Will the enquiry affect my existing Pension?
No, your existing pension arrangements will be unaffected by the enquiry made.
Will I have to go to Court?
No, Court proceedings will not be required.
Will I have to pay costs or fees?
The initial enquiry made by us will be completely free of charge. Once the initial free enquiry is completed, we will let you know whether or not it is worth making a formal complaint. If it is worth making a formal complaint, we will contact you to enter into a No Win No Fee Agreement. Under that agreement, if the case is not successful, we will not charge you anything. If it is successful and compensation is awarded, then we would deduct a success fee of 20% plus VAT from the compensation. There would be no other charges.
Who pays the compensation?
If the Pension company provided the advice they will be liable.
If the independent adviser is no longer in existence we can pursue the claim with the Financial Services Compensation Scheme.
How long will the claim take?
The initial free enquiry will usually take up to 3 months. Occasionally this can take longer if the pension providers have problems locating your records or if the pension arrangements are complex. If, after the initial free enquiry, it is found that a formal complaint should be made, then this can take a further 6 to 12 months due to the complexity of the investigation and loss assessment.
What happens if the Financial Adviser is no longer in business?
If the advice to transfer your Occupational Pension was given by an Independent Financial Adviser (IFA) then it is possible they may no longer be in business. We are able to access the Financial Conduct Authority Register to obtain details of IFAs and also the Financial Services Compensation Scheme (FSCS) register of failed firms to establish whether a claim for compensation can be made.
What is the role of the FSCS?
The FSCS protects customers when authorised financial services firms fail. This means that the FSCS may pay compensation if an IFA is unable, or likely to be unable, to pay claims against it, subject to certain criteria being met. If your claim needs to go through the FSCS, we will contact you at the appropriate time to give you full detailed advice.
How is compensation paid?
You may receive the payment directly to you, or it may be paid into your pension to top it up.
